1. Agreement to Terms
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and DeraMotion Lifestyle Development Consultancy LLC-SPC (“DeraMotion,” “we,” “us,” or “our”), a business registered under Tajer Abu Dhabi, United Arab Emirates, concerning your access to and use of the deramotion.com website as well as our assisted stretching and mobility services (collectively, the “Services”).
By accessing our website or booking a session, you agree that you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with these Terms, you must discontinue use of the Services immediately.
2. Our Services
DeraMotion provides mobile, practitioner-assisted stretching and mobility sessions delivered at a location of your choosing within our service area in Abu Dhabi.
Medical Disclaimer: DeraMotion is a wellness service, not a medical service. Our trainers are not physicians, physical therapists, chiropractors, or other licensed medical professionals. Our sessions do not constitute, and should not be relied upon as, medical advice, diagnosis, or treatment. If you have an acute injury, a diagnosed medical condition, or are recovering from surgery, you should obtain clearance from a doctor or physical therapist before booking a session with us.
3. User Representations
By using our Services, you represent and warrant that:
- All information you provide to us, including on our health screening (PAR-Q) form, is true, accurate, current, and complete
- You are legally capable of entering into a binding contract
- You will update your information as necessary to maintain its accuracy
- You will not use our Services for any unlawful purpose
- Your use of our Services will not violate any applicable law or regulation
4. Booking, Cancellation, and No-Shows
- Bookings are confirmed subject to trainer availability at the time and location requested.
- We require at least 24 hours’ notice to cancel or reschedule a confirmed session.
- Cancellations made after this window, or no-shows, may be treated as a completed session and charged or forfeited accordingly.
- At our sole discretion, we may make exceptions to this policy, including offering a limited grace allowance for a first-time or occasional late cancellation.
- Cancellations or rescheduling requests must be made via WhatsApp or phone using the contact details provided to you at the time of booking.
- We reserve the right to cancel or reschedule a session due to trainer unavailability, safety concerns, or circumstances beyond our reasonable control, in which case we will notify you as soon as reasonably possible.
5. Health, Safety, and Assumption of Risk
By booking and attending a session, you acknowledge and agree that:
- You will disclose all relevant health information accurately and completely before your session
- You will promptly inform your trainer of any pain, discomfort, dizziness, or other adverse reaction during a session
- Stretching, like any physical activity, carries an inherent risk of injury, and you voluntarily assume this risk by participating
- You will be asked to review and sign a health screening form and waiver of liability prior to your first session, and your continued participation in sessions constitutes ongoing acceptance of its terms
- DeraMotion, its trainers, and its officers shall not be liable for injury or harm resulting from your failure to disclose relevant health information or your failure to follow trainer instructions
6. Fees and Payment
- Prices for single sessions and packages are as listed on our website at the time of booking and are subject to change without prior notice for future bookings.
- Purchased packages must be used within any validity period communicated to you at the time of purchase, where applicable.
- Payment is due at the time of booking or at the session, as specified during checkout, and may be processed via our third-party payment provider.
- We reserve the right to refuse or cancel any booking at our discretion, including in cases of suspected fraud or abuse of promotional offers (such as the first-time client discount).
7. Intellectual Property Rights
Unless otherwise indicated, all content on our website — including text, graphics, logos, images, and the “DeraMotion” name and branding — is owned or licensed by us and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use our website for your personal, non-commercial use. You may not reproduce, redistribute, or otherwise exploit any content from our website without our prior written consent.
8. Prohibited Activities
You may not access or use our website for any purpose other than that for which we make it available. Prohibited activities include, without limitation:
- Attempting to bypass any security measures on our website
- Using our website to transmit any harmful or unlawful material
- Attempting to impersonate another user or person
- Using automated means (bots, scrapers) to access our website without our permission
- Harassing, abusing, or threatening our staff or trainers
9. Limitation of Liability
To the fullest extent permitted by applicable UAE law, in no event shall DeraMotion, its officers, employees, or trainers be liable to you for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, even if advised of the possibility of such damages. Our total aggregate liability to you for any claim arising from these Terms or your use of the Services shall not exceed the total amount you paid to us for the session(s) giving rise to the claim.
10. Indemnification
You agree to defend, indemnify, and hold DeraMotion harmless from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your breach of these Terms of Use or your misuse of the Services.
11. Term and Termination
These Terms remain in full force while you use our Services. We reserve the right, without notice, to deny access to or use of our Services to any person for any reason, including breach of these Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates and the applicable regulations of the Emirate of Abu Dhabi. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Abu Dhabi.
13. Corrections and Modifications
We reserve the right to correct any errors, inaccuracies, or omissions on our website, and to change or update information at any time without prior notice. We also reserve the right to modify these Terms at any time; changes will be effective immediately upon posting, and your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
